Details of our Terms and Conditions
By entering this website you have released and discharged the providers/owners and creators of this site from any and all liability which might arise from using this website.

All orders placed by you and purchases of goods from us (whether in-store, by telephone, via our website or by such other means as we may permit) are on the basis of these Terms and Conditions and are subject to acceptance by us either (as applicable): (i) by delivery of the goods to you; or (ii) by providing the goods you have purchased to you at the trade counter, at which point a legally binding contract is constituted between us.

Detailed Description of goods and services
SmartLabs (Smart Science Labs (PTY) LTD) is a business in the education industry that is one of the leading school laboratory equipment suppliers in Sub-Saharan Africa. We provide schools with practical and cost-effective solutions.

Terms of sale
All sales by SmartLabs (Smart Science Labs (PTY) LTD) to the Purchaser will be subject to the following terms and conditions and in dealing with SmartLabs the Purchaser accepts that these terms and conditions shall apply to any Contract and/or Sale between the parties.

1.) SmartLabs may refuse to supply goods to a minor who does not have the consent of a parent or guardian.

2.) Quotations are valid for a period of 30 days. Pricing is subject to change without notice. SmartLabs reserves the right to vary quoted pricing, but whenever possible, SmartLabs shall notify the customer of such an amendment.

Quoted price excludes delivery and installation unless otherwise agreed in writing. Please confirm price before ordering.

3.) Prices quoted by SmartLabs are ex seller’s warehouse unless otherwise agreed in writing.


Payment Options Accepted
Payment may be made via Visa and Mastercard.


Card Acquiring and Security
Card transactions will be acquired for SmartLabs via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.


Merchant outlet country and transaction currency
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

Export Restrictions
The offering on this website is available to South African citizens only. Should you reside outside of South Africa, you are still more than welcome to contact us via email or telephonically for further assistance.


Delivery Policy
4) The following terms and conditions will apply for delivery

4.1) Subject to availability and receipt of payment, requests will be processed within 4 days and delivery confirmed by way of email, in person or telephone.

4.2) The Purchaser is responsible to effect whatever insurance is required at the Purchaser’s expense.

4.3) SmartLabs reserves the right to use third party companies (couriers as well as South African Post Office) for deliveries.

4.4) When using a third party company for delivery the third party’s terms and conditions as well as SmartLabs terms and conditions, as stipulated, will apply.

4.5) Claims for goods lost or damaged in transit should immediately be lodged with the carrier concerned.

4.6) Proof of delivery (POD/ Delivery Note) may be requested by the Purchaser to confirm delivery.

4.7) SmartLabs is not responsible for any lost or damaged goods after the Purchaser signed the Proof of Delivery.

4.8) When a staff member of the Purchaser signs the Proof of Delivery (POD /Delivery Note) SmartLabs will assume that the signee has the authority to accept the goods.

4.9) The customer agrees that SmartLabs may provide the customers contact information, including email address, contact information such as mobile and land line telephone numbers and physical address, to the shipping company in order to make delivery possible.

5) Delivery dates provided by SmartLabs are indicative only and made without obligations. The Purchaser accepts that there will be no claim against SmartLabs for failing to deliver goods by any specified date and that late delivery will not provide grounds for cancellation of any orders.


Return Policy
6) The provision of goods and services by SmartLabs is subject to availability. In cases of unavailability, SmartLabs will refund the client in full within 30 days. Cancellation of orders by the client will attract a 10% administration fee.

6.1) Customers are expressly requested not to return goods without obtaining both authority to do so and instructions on the packing and carriage of such goods.

7) SmartLabs will arrange for collection of incorrectly delivered goods if goods are reported to SmartLabs in writing within 10 working days after the goods were delivered to the Purchaser.

7.1) If goods are not reported as incorrectly delivered within the 10 working days then the Purchaser will be deemed as impeding any reasonable action by the supplier or deliverer to recover the goods within the time allowed and the Purchaser will be liable to return the goods to SmartLabs in the original condition within 30 days of delivery of goods.

7.2) If the goods are not returned within the 30 days then SmartLabs will deem the goods sold to the Purchaser and the Purchaser will be liable to settle the account.

8.) The Purchaser has the right to return any unwanted goods for a full refund on the goods (strictly no refund on delivery costs) if the goods are in its original condition.

8.1) SmartLabs reserves the right to impose collection and handling charges for returned goods that are in the original condition and conformed to the description as provided by SmartLabs.

8.2) Additional charges may apply if goods are opened or used.

9) Credit for goods returned can only be given, or exchange made, if written permission has been obtained beforehand.

9.1) Refunds will only be processed after bank clearance and confirmation of the Purchasers particulars.

10.) Ownership of the goods remains vested in SmartLabs until fully paid for by the Purchaser. The risk in goods sold is passed to the Purchaser at the point of delivery to the Purchaser or to the delivery agent. It is the responsibility of the Purchaser to request and pay for the insurance of goods ordered.

11.) All payments are strictly cash on delivery or EFT before delivery. No product will be released before bank clearance.

12.) Under no circumstances whatsoever shall SmartLabs’ liability to the Purchaser exceed the invoice price of the goods purchased, whatever the subject of the claim.

13.) The Purchaser accepts that responsibility rests solely on the Purchaser to determine that goods obtained from SmartLabs are suitable for the Purchaser’s intended use.

13.1) The Purchaser can view the description and product images at www.smartlabs.co.za or in the product catalogue

14.) The Purchaser agrees to hold SmartLabs harmless and indemnify SmartLabs against all claims by all and any third party arising from the use of goods whether these claims are the result of direct or consequential damages.


Goods / Products Policy
14.1) SmartLabs will not be held responsible for any death or injury resulting from

misuse, malfunction or unauthorised use of any items supplied by SmartLabs.

14.2) The purchaser accepts that all goods supplied by SmartLabs are to be used strictly in accordance with the manufactures printed package insert supplied with the goods at the time of supply.

14.3) It is the responsibility of the Purchaser to read the user manual on each product and use adequate safety precautions as indicated by the manufacturer when using any goods supplied by SmartLabs.

14.4) It is the responsibility of the Purchaser to arrange for adult supervision and safety precautions for all products used by minors.

15.) The Purchaser is responsible for the repair and maintenance of all the goods supplied. Maintenance guidelines (where applicable) may be found in the product guide or product user manual.

16.) The Purchaser agrees that any advice or assistance by SmartLabs staff is given out of good faith and will not be treated as a recommendation to adopt any procedure contrary to the manufacturer’s printed packaging insert or commonly accepted Laboratory Practices.

17.) The Purchaser is responsible for the safe disposal (of goods that require safe disposal) and any costs resulting from the safe disposal of goods supplied by SmartLabs.

17.1) The Purchaser agrees that SmartLabs will not be held liable for any incorrect or unsafe disposal of goods supplied by SmartLabs. The Purchaser will be liable to any third party claims arising from the unsafe disposal of goods.

18.) All products supplied by SmartLabs that are covered under a manufacturers’ warranty must be returned to or collected by the manufacturers’ warranty centre as indicated in the warranty booklet supplied with the goods. For more information about the manufacturers’ warranty please see the warranty booklet or the user manual that is supplied with the goods.

19.) All goods are subject to availability. While we endeavour to hold sufficient stock to meet all orders and purchases, if we have insufficient stock to supply or deliver the goods ordered and paid for by you, we will attempt to contact you using the details you have provided to us to ask you how you wish to proceed. We may, at our discretion, process any part of the order which is available. Where goods are out of stock, we will refund you the price paid for such goods as soon as possible and in any case within 30 days or, in the case of an account customer, we may, in our absolute discretion, as soon as possible raise a credit to offset the amount invoiced to you.

20.) Occasionally, an error may occur and goods may be either incorrectly priced, incorrectly discounted or described incorrectly, in which case we will not be obliged to supply the goods at the incorrect price or in accordance with the incorrect description or at all. We reserve the right to correct any errors from time to time. We will (at our discretion) either cancel your order and refund the price you have paid or use reasonable endeavours to contact you and ask you whether you wish to continue with the order at the correct price or correct description. If we are unable to contact you or you do not wish to continue with the order at the correct price or correct description, we will cancel your order and refund the price you have paid.

21.) Images as well as all content from our website is copyright unless otherwise stated. You may not use or reproduce any content found on our website without prior consent. Legal action will be taken for offenders found to be using or displaying any copywritten media from this website and our affiliate websites.

22.) SmartLabs shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from:

22.1) smartlabs.co.za is truly committed to protecting your privacy and will under NO circumstances give out, sell, share or disclose any of your private information. Your information will strictly only be used for the products and services you request.

This privacy statement discloses what information we gather about you when you visit the Site and describes how we use that information. Our policy is to keep the personal information we receive from our Site completely confidential and used solely for internal purposes. We will not share your personal information with any other parties.

 

Customer details separated from card details
23.) Customer details will be stored by SmartLabs separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za.

23.1) The personal information we collect may include your name, title, company or organization name, e-mail, phone. We may collect certain information about your visit, such as type of browser you use; the date and time you access the Site; the pages that you access while at the Site and the Internet address of the Web site from which you linked directly to our Site. This information is used to help improve the Site and administer the Site.

Use of your personal information

24.) The personal information collected on this Site will be used to provide the services you have requested. We may use your personal information to provide you with important information about the product or service that you are using, including critical updates and notifications. Additionally, we may send you information about other smartlabs.co.za products and services.

25.) By accepting the terms and conditions the customer agrees to and provide consent for SmartLabs to contact the customer regarding the sale. Furthermore the customer may be contacted by SmartLabs for marketing and sales related advertisements provided that the customer has the option to unsubscribe to the service. SmartLabs shall not sell or distribute the customers information as provided, unless for shipping, criminal or legal reasons.


Responsinbility
SmartLabs takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.


Country of Domicile
This website is governed by the laws of South Africa and SmartLabs chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 27 Dr Vosloo Road, Unit 6 & 7, N12 Industrial Park, Bartlett, Boksburg.


Variation
SmartLabs may, in its sole discretion, change this agreement or any part thereof at any time without notice.
